Everyone knows that a braided rope is stronger than its individual strands. The bible says a threefold cord is not easily broken. In fact hanging by rope has broken more necks that ropes. In our sinful nature there is a threefold cord not easily broken; our blind reason, our perverse heart, and our distempered affections. This cord has had a strangle hold upon our necks during our entire existence.
The blind reason argues it should not bow to the Lordship of Christ. The perverse heart says it will not bow. The distempered affections in support of the others says it shall not bow.
One of the biblical names for sinners can be translated wild-ass men. The renown of the stubborn ass easily recalled. The law addressed the ass in a telling way. The firstborn of an ass was to have its neck broken. To redeem the ass a lamb could be slain. The type made obvious toward Christ. This root of sin within us, this threefold cord has us under noose in the hangman’s peril. The law against it calling for our broken neck, yet what is not possible for man is possible with God. He can liberate us from the strength of this cord and break its death grip over us. Only His love can serve it. So the question bids do I stretch my neck in search of His love or stretch my neck in the leap of death?

GMAC Mortgage LLC, after defeating a bid by homeowners in Maine who sought a federal courtU.S. District Judge D. Brock Hornby, at a hearing yesterday in Portland, Maine, declined to grant a temporary restraining order that a plaintiff’s lawyer said would have kept GMAC from selling foreclosed homes and evicting residents. The judge said his decision hinged on the power of federal courts to stop proceedings in state courts, where foreclosures take place. He said individual homeowners who face losing their homes in a foreclosure sale can go to state court to stop the sales, he said.
“This decision is based on the limited authority federal courts have,” Hornby said.
The Maine case, filed in state court in October and moved to federal court by GMAC in November, involves five homeowners who are suing GMAC, claiming the company relied on defective court documents in seizing homes. The plaintiffs are seeking to represent Maine homeowners who are facing foreclosure by GMAC or who lost their homes in a GMAC foreclosure during the past six years and whose case relied on false documents, according to court documents.

GMAC said in a statement that there was “nothing fraudulent or deceitful” about its foreclosure practices and that it would be “fully vindicated.” (IT'S GOOD TO HAVE BOUGHT FEDERAL JUDGES IN YOUR POCKET)
"This system does not work if GMAC commits abuses and fraud,” Stark told Hornby during arguments yesterday. “GMAC has repeatedly abused this process by presenting fraudulent representations to courts around the state.”
Thomas Cox, a lawyer for the plaintiffs, said after the hearing that GMAC took advantage of federal legal procedures to move the case to federal court in a move to block a temporary restraining order “and deprive these plaintiffs of an opportunity to have their claims considered on the merits.”

With everyone focused on whether or not the Build America Bond program will be extended (it appears it won't, and is the main reason for the market weakness today), after rumors earlier that the program may not be part of the negotiated extension (and why not? It's not like republicans are suddenly pretending to be fiscally prudent, after pushing the latest addition to the welfare state that will cost $5 trillion in future debt) we now learn that pathological nest of infinite criminality better known as Bank of America has again settled a new SEC fraud charge, this time relating to its municipal securities program. According to Reuters headlines, the SEC has sued Bank of America Securities with fraud in connection with allegations of improper bidding practices involving municipal securities. But heaven forbid the SEC would settle on anything more than a, well, settlement: just as the charge was announced, so was the settlement, and we learn that BofA has agreed to pay more than $36MM in disgorgement, and that is and affiliates to pay another $101MM to Federal and state authorities. SEC wristslap... and the bank can go bank to stealing.
And while we go back to pretending we have a market regulator, Bernanke's monetization of all municipal bonds is now just around the corner.
