Foreordained Foolishness

We have been under nearly 500 years of the reformation, which accepted a predestination quality to God that far exceeds reality. I bring this up because it is evident that my detractors are tainted by this view whether they know it or not. In their foreordained foolishness they have a God boxed into their idea of justice, truth, and a rigid unchanging thoughtlessness. God is a free thinker with emotions motives and purpose. This is a serious force to be reckoned with no doubt but not omniscient in our narrow view. When he purposed in His will to challenge the fraud of this self-willed generation He didn’t map it all out at the expense of the freewills of His creation. Scott and I had choices and still do. It is the choices made in faith that allow God to enter into all things for the called according to His purpose. Our hope in victory is not some naive idea of good prevailing over evil and the like. It is more based on God being free to be Himself and following His lead in the choices made. It cannot be a coerced response from us but a voluntary one. You are faced with the same choices. Most of you have followed the advice of conflicted evil lawyers cutting off the reach of God’s hand towards you. You can blame all you like your sorrows on us or someone else but you will stand alone before God on your choices. I do not have to be doing what I’m doing. I’ve had a thousand exit options including never coming to prison, but the choices I made brought me here. Like waves that beat against a shore they never stop coming but the shore which was promised by God to restrain it is never moved. Our promises will likewise survive the beating because voluntarily like God we have given ourselves over to the promise of God’s word. His action towards His purpose and our voluntary trust assures the outcome not some petty box of formulas you can reason out.

It sounded too good to be true; Pay off your mortgage and pocket $60,000 to boot.

Unfortunately, some Tega Cay residents had to find out the hard way that in most cases, what sounds too good to be true usually is. One couple even faced jail time for their in-volvement in the alleged sch-eme. Rodney and Deborah Austin, of 8041 Windjammer Drive, were charged with being involved with a "much larger scheme," according to Assistant Solicitor Kevin Brackett.

After agreeing to testify against the accused ringleaders of a nationwide mortgage debt elimination scheme, the Austins may not see any jail time.

The charge against Deborah Austin, obtaining a signature or property with a value of more than $5,000 under false pretense, was dropped in return for her and her husband's cooperation.

Rodney Austin, who Brackett described as the "brains" of the couple's operation, was given a 10-year suspended sentence and placed on probation for two years after pleading guilty to the same charge his wife faced.

"In the fraud food chain these guys were bottom feeders," Brackett said. "We like to catch the little guys but we want to make sure the big fish get hammered too."

According to Brackett, the Austins were involved with an organization called the Dorean Group based in California. Dorean was run by two men, D. Scott Heineman and Kurt F. Johnson.

According to a federal indictment against Heineman and Johnson, the scam worked like this: an agent for the Dorean Group, like the Austins, lured a potential client with the promise of eliminating his or her mortgage and making $60,000 or more in the process.

The Dorean Group charged a fee that ranged from $1,000 to $3,000 per debt to be eliminated and the clients would promise to give the Dorean Group half of the redeemed mortgage. After the initial fee the Dorean Group and its client would form a trust naming Heineman and Johnson as trustees. The client would then file a quitclaim deed supposedly transferring the client's title interests to the trust.

Next, the Dorean Group mailed a "self-executing presentment packet" to its client's creditor demanding the creditor prove the validity of its loan to the sole satisfaction of the Dorean Group within 10 days. If the creditor didn't answer in time documents in the packet claim that due to the creditor's "tacit assent" and "default" Heineman and/or Johnson, "act as the lender's agent and attorney-in-fact as to the loan and the secured property."

Also, if the creditor chose to prove the validity of its loan but did not meet the Dorean Group's satisfaction, documents in the packet claim the creditor was liable to the Dorean Group for damages 20 times the amount of the loan, according to the indictment.

After the 10-day period elapsed the Dorean Group filed a "Substitution of Trustee," "Specific Power of Attorney" or a "Power of Attorney," depending on the jurisdiction, claiming Heineman and/or Johnson were acting as the agent or attorney-in-fact for the creditor.

Allegedly acting as the creditor's agent, Heineman and/or Johnson would prepare a "Full Reconveyance," a "Discharge of Mortgage" or a "Satisfaction of Mortgage," depending on the jurisdiction. That document would state the mortgage had been paid when in fact it had not, "causing title of the property to falsely appear free and clear of any encumbrances," according to the indictment.

Finally, came the payoff in which the client was directed by the Dorean Group to use the newly cleared title to obtain another home equity loan from another lender. Once the funds are disbursed the Dorean Group got 50 percent of the loan, the Dorean Group agent that brought in the client would get a 10-25 percent cut and the client would keep what was left.

The new loan would then be subject to the same scam and never be repaid.

According to records obtained by the Fort Mill Times, including legal advertisements placed in another local newspaper, the Austins set up trusts linked to Dorean on three different properties in Tega Cay. However, they were only criminally charged in reference to one of the properties, Brackett said. Only one of the victims still lives in South Carolina and pressed charges.

Heineman and Johnson were already in prison awaiting trials when the Austins were arrested last October. Shortly after their arrests federal holds were placed on the Austins. According to Brackett, a U.S. Attorney and an FBI agent talked to the Austins before they agreed to testify against Dorean.

"Their contention was they were suckered by Dorean too," Brackett said.

Problem with the story you quoted is that these people obviously pled guilty out of fear.
Did they really break the law or were they set up by a government agency bought & paid for by the banks?
If Dorean is a scam we all need to back out. Question: how can we be sure if this program is real or not? There are a few rational people making arguments on both sides of the issue. How can we indepently determine the reality of this program? Thanks

The fact that the banks are committing fraud has been established.

There have been numerous companies out there (besides Dorean) who have used different approaches to challenge this fraud.

Some have been more successful than others.

Some have the same disease as the banks (greed-omnia) and they are using the TRUTH to fill their pockets. (Some individuals on this blog think Kurt and Scott fall into this category but theres too much evidence to disprove that in my opinion).

Some have been litening rods that have gotten hammered by an opponent (banks) that dont want the TRUTH to come out and become a widespread belief. The banks will stop at nothing to hold on to their system. They could care less about putting innocent men away to rot in jail.

I think the most important thing for people to do is educate themselves. Kurt has been saying this since day 1. We cant continue to rely on groups like Dorean (as justified and lawful as they may be) to process our paperwork and we just sit back and watch the ballgame on the coach....I think those days are numbered. We need a growing multitude of people who have decided to get the KNOWLEDGE and then apply it.

Its too easy for them to slap a couple of guys around that represent thousands, but when the thousands enter the fight guess who gets slapped around.

Giant comet may collide with Earth late October

According to the Russian astronomer Nikolai Fedorovsky, a giant comet flying at top speed is bound for Earth. Should the comet stay on the collision course, it may hit the planet in late October. The impact will cause devastating tsunamis, earthquakes and avalanches, says Fedorovsky. He saw the killer comet in a telescope two weeks ago. He managed to calculate the comet’s trajectory. We got in touch with Nikolai Fedorovsky:

“Just a few people are aware of the fact that comets of various sizes fly past Earth at a very close distance on a regular basis,” says Fedorovsky. “Those comets usually pass by unnoticed. The above circumstance is not a guarantee against disaster by any means. The Tunguska meteorite landed in the wilderness of Siberia. What if the behemoth had plunged into the center of Europe or somewhere in the ocean?

“I’m not trying to scare anybody, I just want to warn the public,” sums up Fedorovsky. “We should pay attention to this suspicious celestial body. We could obtain more accurate calculations if other astronomers join forces. We could also photograph it if we’re in luck. We will probably partake in one of the greatest events in the history of humankind,” adds he.

“We shouldn’t underestimate the threat poised by asteroid and comets,” says Igor Gerasimov, deputy director of the Sternberg Astronomical Institute. “More than a thousand meteorite showers cross Earth’s orbit and pose a real threat to life on the planet. We’re watching only nine showers of the above number. Those nine have several dozen objects, which may collide with Earth. The size of the objects varies. Some of them are tiny dust particles while the others have the proportions of gigantic heavenly bodies measuring up to 200 meters in diameter.”

The solar system has about two million asteroids measuring more than 50 meters in diameter in. About 4,000 asteroids of the above category have been discovered so far. The number of those under monitoring is even smaller. In fact, many asteroids and other celestial bodies remain unnoticed until they approach Earth. One of such asteroids was discovered in the process of examination of a picture taken by Hubble Space Telescope in 1998. Some of the asteroids come into view shortly after passing past Earth into the Moon’s orbit. About a dozen asteroids approach Earth presently. They measure more than 5 km in diameter. Scientists estimate the above celestial bodies may collide with Earth once every 20 million years.

Soon there will be 500 asteroids (over 1 km in diameter) approaching the planet Earth. An asteroid like that may fall Earth once every 100 000 years. A global catastrophe is very probable if the thing really goes down in flames.

The possibility of a chance meeting with smaller celestial bodies is much greater. Earth will be covered with the “space burns” (craters measuring hundreds of kilometers across) as a result of such an encounter. Small fragments of asteroids (one-meter pieces, rocks and dust particles) hit the ground all the time. Fortunately, they do not cause any substantial damage. The biggest problem is that celestial bodies show up at a very short notice. Needless to say, they come out of the blue with no exact specifications attached. Therefore, the risk of a sudden collision would be a lot higher of the astronomers stop monitoring potential troublemakers.

“The geochemical and paleontological data shows that a celestial body about 170-330 km in diameter collided with Earth in the northern part of the Yukatan Peninsula some 65 million years ago at the turn of Cretaceous period of the Mesozoic era,” says Academician Alexei Rozanov, director of the Institute of Paleontology of the Russian Academy of Sciences.

“The crater called ‘Chiksulub’, 180 kilometers in diameter, is a mark of the impact.

The capacity of the blast is estimated at 100 million megatons. A huge amount of dust totaling one million tons was thrown into the atmosphere during the blast. Consequently, a six-month night fell over the planet. More than a half of all existing kinds of animals and plants perished. The global winter that followed may have killed the dinosaurs,” adds Rozanov.

“There’ll be more reports about new asteroids spotted in the vicinity of Earth. However, it’s not doomsday or anything of that kind. It’s just a sign of the solar system’s usual life,” says Igor Gerasimov. “A network for uninterrupted monitoring of celestial bodies was set up to protect Earth against the consequences of unwanted visits. Robotic telescopes watch the sky round the clock. Several observatories in different countries including Russia make part of the network,” adds Gerasimov.

Let us assume that a potentially dangerous object has been located, and it is heading Earth. What shall we do? There are a number of plans for the occasion. However, the implementation of those plans will require a higher level of technology, not to mention the funds. One of the plans involves the physical destruction of an object (see the 1998 movie Armageddon for further references).

Scientists also suggest that an object’s descent trajectory be changed. Part of the object should be covered with chalk to attract more sun beams to the latter. The move is thought to be able to change the speed of the object and the direction it rotates. Predictably enough, the amount of chalk is the biggest stumbling block. According to estimates by American scientists, 250 thousand tons of chalk would be needed to change the orbit of the asteroid dubbed “1950 DA.” Besides, as many as 90 booster of Saturn-5 type would be required for carrying the chalk to the object. Well, it still looks very sci-fi.

As for the “Fedorovsky asteroid,” all the above scientists believe the report is either a mistake or exaggeration. “We’ll surely see more reports like that in the future. But we shouldn’t fly into a panic each time we see another doomsday being announced in the press. Let’s keep our fingers crossed and hope that the thing will fail to hit our planet,” says Igor Gerasimov.

Again, don't confuse the criminal cases with the Federal civil cases where the program has been ruled an illegal scheme by the courts (the multiple cases combined under Kenney in CA as well as the Julian and Lembeth cases in the Carolinas). The lenders/servicers won those. The arguments made by the Dorean team were so utterly foolish that the CA attorney who filed them was sanctioned and fined and the NC attorney was threatened with them. Attorneys are supposed to be honest enough not to try and convince a court that the world is flat or the sun orbits the moon. Presenting arguments that are utterly frivolous and not made in good faith is a no no.

Unless and until someone who lost in those cases appeals and prevails in the appellate courts, the Dorean program is nothing more than bovine scatology that people got suckered into and need to get out of.

Now I beleive that's a "rock", and a window I'm not so.....

First off I don't know where the hell you've been but from what your saying it would have me thing you just got here.

Here try this for the real deal about what Kurt was doing when the Fed's were looking for him. He went to the office everyday to work on clients files and in fact offerd to have the clients come there also and learn as they worked their own file. Now that's the rael truth about what Kurt was doing. It is a far cry from hiding or running as you say Ohsurewhoknowswhy you whoul say thing that are'nt true.

I'm so sure about this that if fact there is a post from so saa hole telling someone that offered to go and help out that they could stay away from their file. that would be posted back around the time .. oh let me see when was that? ... Oh ya the time this blog got started. So go see if you can find some real facts to post before you start throwing rock again. Or are you the type that just likes breaking windows for the fun of it? I think that there is way to much of that going around about alot of topics out there. In fact The word's (I can't) were removed from action in my house when my daughter was born. If you start by telling your self your going to fail at something than why even try. lisen one day and see how many times you hear the word's spoken in one way or another like fail, can't usless, dumb, stupid, worthless why bother, ect. so what I geuss I'm saying here is that you spend aloyt of time on here telling everyone how you think they will fail or have instead of maybe putting that time into something that was helping or making something better. I don't just mean Dorean. you get the idea I sure. So there you go, I have just answered a question that your asked me along with your copy of that pay thing and that was? I'm sure you remember that to but just for the record ... Let me ask you, if you had a $1 million dollar lien against your bank (perfected by a UCC-1 due to your lack of response to a notary protest) and the lien your bank had on the home in question was say, under $50k, what would you do? Believe it Elmo, it's true. It's called equity in law!

Do you want more proof? Visit the California SOS and there you'll find about 350 of them filed. Why are YOU concerned anyhow? Aren't you a millionaire, and don't you own a mansion and a yacht Elmer J. Fudd? Or, do you have a vested interest somehow?

dgwondering, if you spent as much time researching contract law and the UCC as you do lamenting about how allegedly illegal this process is, you'd figure out that these liens as well as the process taken to perfect them are 100% legal and as such, the reason why I don't have a mortgage payment either. OBTW, I'm not promoting an alleged scam, I'm proof that it works.
