I’m So Happy (05-09-07)

Well I’m back at FDC so that I can finish my job of winning this trial. The good news is they have just disallowed my wife to visit me. Whaw! Whaw! How much should I cry? I love my wife, her suffering hurts more than mine. She has sacrificed her husband for two years because she trusts God and believes in His plan. If I were like you I would sacrifice the goal for my immediate comfort because life is all about me. You are all going to pay me well for these unappreciated tortures. Don’t worry I’ll make sure you are paid well also. I’m not against you but for you sharing in your sufferings. My tears are as salty as yours. Even behind this pain I’m so happy. How many times does a man get the opportunity in a lifetime to practice deep spiritual truth in a practical and beneficial area that affects so many in his generation? I know many a men who have prayed for opportunities like this but in seeing the pain refuse the offer. How are we really going to look our kids in the face when our grandkids have to work to maintain the household? You watch it is coming if we remain idle. Pray for my wife and all those who are suffering that God in His mercy will give us all enduring faith and cut short our trial. I know we are all tempted to say we can’t take any more pain but here you are after having said it many times. You’ll make it and so will my wife and I. In the end when the severity gives way to gentleness we’ll all be happy!

I'm proud to announce that Duke and I have come to a monetary settlement for the purchase of the Bush's Baked Beans Recipe. What's a cookout without Baked Beans?

I'm ready Kurt!!!!!! I've got the grill fired up and now the Baked Beans to serve!!!!!! And after 30 e-mails of begging from TCOB, we will have the Sponge Bob Bounce House at the big event as well!!!!!

I have a friend who is going through a divorce. I spoke with him to give him words of encouragement and hope that he would pull through this ordeal a better person. However, with his distrust of women so severe, he made a statement that I had never heard before........

Your postings are nothing more that the combined effects of air, carbon, hydorgen, & hydrogenmethaine formed in a petro based formation thatwhen the liquid isproduced in the form of an atomized state then a force of 2000 lbs is there by brought on it cause it to explode and the lasting impression left by this combind mix is a gassish smell in the form of hydrocarbons that leaves a great big hole for everone eles to deal with .

Another one of your lies Mr. Notarial Dissent, is that you said that the "United States District Court (USDC) has original jurisdiction over all criminal matters" like Kurt & Scott's case.

We see that the true phraseology says that “The district courts of the United States
(DCUS) shall have original jurisdiction.......” [Emphasis added]. It does not say “The United
States district courts shall have original jurisdiction...”. There is a difference in the meaning of the two.

Obviously to have bona fide “original jurisdiction,....of all offenses...”, in
addition to a bona fide prosecution occurring in the proper court, such offenses must be bona
fide offenses, and in order for there to be bona fide offenses in the above captioned “case”, even
if said “case” had been in the proper court, there must be established, in the written public record
of the above captioned case, bona fide charges of such bona fide offenses as well as bona fide
documented evidence of such bona fide offenses which has been entered into said record by a
bona fide competent fact witness or witnesses. In order to have bona fide charges, those who
allegedly bring forth the charges must be bona fidely in office and possessing the bona fide
delegation of authority to bring forth the charges.

In addition to having to meet mandatory residency requirements, there are also certain
requirements for an alleged “judge”, and alleged “U.S. Attorneys” and others acting on
behalf of the federal corporation known as the United States to have taken certain oaths
and for those oaths to be properly preserved. To the best of my knowledge, understanding
and belief, if those who purport to act on behalf of said United States do not have such
proper oaths on file, such actors are not properly and bona fidely “in office” and all
actions taken by them are a nullity, ab initio.

The silence of the lenders have justified the acts of the Dorean trustees, so no fraud can be maintained:

Here is a well-settled case 741 F.2d 336, Trezevant v. City of Tampa, clearly supports
a claim for Kurt & Scott of being “entitled to compensation for the incarceration itself and for the mental anguish that they have suffered from the entire episode” since the Court has proceeded improperly.

The Federal Court has never provided Kurt & Scott with bona fide written due notice of the specific Act of Congress that such false imprisonment was made pursuant to, as required by 18 USCS 4001(a), which states:

“No citizen shall be imprisoned or otherwise detained by the United States except pursuant to an Act of Congress.” [Emphasis added]

Court has also failed to provide them with bona fide written due notice of how an
“Act of Congress” applies to them in any bona fide way. Consider Rule 54, Federal Rules of
Criminal Procedure, definition of Act of Congress, which clearly shows that, any such Act of
Congress is limited in its applicability, namely:

A. “ “Act of Congress” includes any act of Congress locally applicable to and in force in
the District of Columbia, in Puerto Rico, in a territory or in an insular possession.”

B. Furthermore, 336 U.S. 281 at 285, Foley Bros., Inc. v. Filardo, clearly states that:
“...legislation of Congress, unless a contrary intent appears, is meant to apply only within
the territorial jurisdiction of the United States,...”

Notarial Dissent: One more point I'd like to make in reference to your statement that "lenders don't have to answer the Dorean Presentment & are free to throw the paper in the garbage can."

The courts have said, "there is a duty to speak whenever justice, equity, and fair dealing demand it."

Therefore, if a lender fails to disclose a material fact or to answer a question asked by a borrower or borrowers agent (trustee), the lender can be liable for fraudulent nondisclosure.

The lending agreement is full of material nondisclosures.

Answer the following questions and decide for yourself if the bank was acting in ‘good faith’, that you received ‘valuable consideration’, and that your ‘signature’ on that agreement is valid.

Were you told that the Federal Reserve Policies and Procedures and the Generally Accepted Accounting Principles (GAAP) requirements imposed upon all Federally-insured (FDIC) banks in Title 12 of the United States Code, section 1831n (a), prohibit them from lending their own money from their own assets, or from other depositors? Did the bank tell you where the money for the loan was coming from?

Were you told that the contract you signed (your loan application) was going to be converted into a ‘negotiable instrument’ by the bank and become an asset on the bank and become an asset on the bank’s accounting books? Did the bank tell you that your signature on the note made it ‘money’, according to the Uniform Commercial Code (UCC), sections 1-201(24) and 3-104? Were you told that the bank was going to “indorse” your note & make it payable to the bank and that the bank would forge your own signature on this note in order to “create new money”for the bank? Were you told that your note is valuable and considered money to the bank?

Were you told that your note or application (money) would be taken, recorded as an asset of the bank, and be sold by the bank for cash-without ‘valuable consideration’ given to obtain your note? Did the bank give you a deposit slip as a receipt for the money you gave them, just as the bank would normally provide when you make a deposit to the bank?

Were you told that the bank would create an account at the bank that would contain this money that you gave them? Were you told that a check from this account would be issued with your signature, and that this account would be the source of the funds behind the check that was given to you as a “loan”? (Why bank will not pay your deposit back???) If you answered “No” to any of these questions, YOU HAVE BEEN CHEATED & the lender hasn't FULLY DISCLOSED the real and material terms of the agreement.
