Friday The 13th (2-13-09)

Many seem to think that this day has a cloud hanging over it. Of course the movie series only enhances this view. My state case began on Friday the 13th. I was shipped from Santa Rita to Utah on Friday the 13th. Being in the SHU this day and my past experience could certainly make that suggestion to me.

I think this way is really the philosophical thought of fate. Fate was kind of the God behind all gods of the Panel in Greek mythology. Even Zues was subject to the force. If I were to adopt this thought in any incremental fashion I would have to do so at the expense of faith. If anything can be considered fatalistic it would have to be the word of God because He does not lie. Unfortunately fate in practice by us is doubt because it ignores the connection between faith and the activation and implementation of God’s word. It is an immutable substance that doesn’t become what is truly intended until faith is blended like an epoxy. The independent freewill objects become a third and new object by their joinder. Certainty attaches at this point but not fate.

I have sensed by comments that many think fate has somehow fixed the outcome of the Dorean process. To me it has been more like warfare that has an outcome determined by the participants. Loyalties, wisdom, weapons, measures and counter measures, and choices seem related to cause and effect. I don’t think the FBI believes in fate. They seem very active with goals independent of my own. I believe the prayers, fasting, and faith of us all has a role in determination. The Word of God has a prophetic set of rails to guide us if we will follow that will cause us to pass through our destination. Faith is our call, fate is for apathetic cowards. Look to the certainty of God’s faithfulness and not the myth of fate.

What Is a Statute of Frauds?
A "statute of frauds" requires that certain contracts be in writing, and that they be signed BY ALL PARTIES to be bound by the contract. Although there can be significant variation between jurisdictions, the most common types of contracts to which a statute of fraud applies are:

Contracts involving the sale or transfer of land;

Contracts to answer for the debt or duty of another.

Seems to me that all lending agreements since they are not signed by the lending party, are voidable since they don't have the lenders signature & they violate the statute of frauds doctrine SINCE THE TRANSFER OF REAL ESTATE IS INVOLVED IN CONSIDERATION FOR A LOAN.

I wonder if this defense was presented correctly that it could be a defense for a foreclosure proceeding?

Instead of asking where is the money, ask the Court, where is the signature on the contract that is necessary, or where is the real contract?

The purpose of a "statute of frauds" is, as the name suggests, to prevent injury from fraudulent conduct. There is some criticism of the continued existence of these statutes, as they are often used by parties who freely entered into fair contracts yet wish to AVOID HAVING TO FULFILL THEIR AGREEMENTS. At the same time, the abuses these statutes were designed to prevent are quite real, so a strong argument remains to keep them in place. It is also arguably good public policy to require that parties to certain significant transactions, such as those of long duration or which involve real estate, reduce their agreements to writing. A writing will both reduce the chance of future litigation, and also give the parties the opportunity to take a second look at the terms and conditions of their agremeent before it becomes final.

You probably know that credit default swap counterparties drive company after company into bankruptcy.

And you probably know that they are getting billions of dollars of taxpayer funded bailouts,

But did you know that - once a company they are betting against goes bankrupt - the CDS counterparties cut in line in front of all of the bankruptcy creditors to get paid?

TPM summarizes the story:

One of the features of the 2005 Bankruptcy bill was to put derivative counter parties at the front of the line ahead of other creditors in bankruptcy proceedings. Actually, from what I can tell, they don't just go to the head of the line. They got to skip the line entirely.

As the Financial Times noted last fall, "the 2005 changes made clear that certain derivatives and financial transactions were exempt from provisions in the bankruptcy code that freeze a failed company's assets until a court decides how to apportion them among creditors."

Great. As if CDS weren't causing enough problems, they often elbow out all other creditors who hold claims against a bankrupt corporation. One question: Does that include taxpayers who are paying for the bailouts?

Note 1: I am for reigning in CDS. But even if you are opposed to regulation, everyone should be against letting powerful groups manipulate laws to game the system.

Note 2: Please don't direct your fury at those folks people whose day job is to trade CDS, but who don't have a say in policy or practice (like the financial blogger Tyler). It is the giant financial companies and wealthiest investors -- and their lobbyists and political yes-men -- who deserve our anger for gaming the system.

A Further Word
“If the foundations be destroyed, what shall the righteous do?”

Recently I felt compelled to send out an URGENT message warning of an impending great calamity — such that will cause even God’s elect to tremble.

One Bishop asked, “Is there no further word: How should the righteous respond to such a word?”

I can only answer by sharing what the Holy Spirit is speaking to my own heart and what I am to do. I shared that I was led in a practical way to lay aside a month’s supply of food — because I have witnessed the panic in the wake of terrorism. That has to be a personal word for every individual.

This is what I hear the Holy Spirit speaking to my heart concerning my own spiritual response to impending calamity. It is simply this —STAND STILL AND SEE THE SALVATION OF THE LORD.

“And Moses said to the people, Fear ye not, stand still, and see the salvation of the Lord, which he will show you today…The Lord shall fight for you, and you shall hold your peace” (Exodus 14:13-14).

This is the attitude of faith in the face of calamity. What could Israel do on the brink of the Red Sea? Pharaoh’s army is pressing in, mountains are on both sides, and there is an impossible sea ahead. The flesh cries, “Do something!”

The flesh cries hopelessness. Can God’s people dry up the sea? Level a mountain? Fight a great army without having weapons? They are in what appears to be a dreadful, frightening situation. God’s people tremble — and in this hour of trembling comes a word from God. In essence:

“Stand still. Fear not. This is the hour of salvation. You are going to witness the pulling down of the foundations of a world power. But in the same hour, I will fight for you. Hold your peace — be still and see my works.”

Beloved, my warning is just one voice among many who are saying the same thing. We may all tremble for a season, but those who truly know God’s Word will be quickly comforted by the Holy Spirit. We will be baptized with a great peace — a supernatural quietness — which will be a tremendous witness to the fearful multitudes.

AN URGENT MESSAGE


I am compelled by the Holy Spirit to send out an urgent message to all on our mailing list, and to friends and to bishops we have met all over the world.

AN EARTH-SHATTERING CALAMITY IS ABOUT TO HAPPEN. IT IS GOING TO BE SO FRIGHTENING, WE ARE ALL GOING TO TREMBLE - EVEN THE GODLIEST AMONG US.

For ten years I have been warning about a thousand fires coming to New York City. It will engulf the whole megaplex, including areas of New Jersey and Connecticut. Major cities all across America will experience riots and blazing fires—such as we saw in Watts, Los Angeles, years ago.

There will be riots and fires in cities worldwide. There will be looting—including Times Square, New York City. What we are experiencing now is not a recession, not even a depression. We are under God’s wrath. In Psalm 11 it is written,

“If the foundations are destroyed, what can the righteous do?” (v. 3).

God is judging the raging sins of America and the nations. He is destroying the secular foundations.

The prophet Jeremiah pleaded with wicked Israel, “God is fashioning a calamity against you and devising a plan against you. Oh, turn back each of you from your evil way, and reform your ways and deeds. But they will say, It’s hopeless! For we are going to follow our own plans, and each of us will act according to the stubbornness of his evil heart” (Jeremiah 18:11-12).

In Psalm 11:6, David warns, “Upon the wicked he will rain snares (coals of fire)…fire…burning wind…will be the portion of their cup.” Why? David answered, “Because the Lord is righteous” (v. 7). This is a righteous judgment—just as in the judgments of Sodom and in Noah’s generation.

WHAT SHALL THE RIGHTEOUS DO? WHAT ABOUT GOD’S PEOPLE?

First, I give you a practical word I received for my own direction. If possible lay in store a thirty-day supply of non-perishable food, toiletries and other essentials. In major cities, grocery stores are emptied in an hour at the sign of an impending disaster.

As for our spiritual reaction, we have but two options. This is outlined in Psalm 11. We “flee like a bird to a mountain.” Or, as David says, “He fixed his eyes on the Lord on his throne in heaven—his eyes beholding, his eyelids testing the sons of men” (v. 4). “In the Lord I take refuge” (v. 1).

I will say to my soul: No need to run...no need to hide. This is God’s righteous work. I will behold our Lord on his throne, with his eye of tender, loving kindness watching over every step I take—trusting that he will deliver his people even through floods, fires, calamities, tests, trials of all kinds.

Note: I do not know when these things will come to pass, but I know it is not far off. I have unburdened my soul to you. Do with the message as you choose.

In the last few years we have witnessed a revolutionary transformation in the freedom movement. During that time, when various people have suggested to me that our commercial procedures are the ultimate remedy, I have suggested that we still face more nights in the desert. In time, the Lord would provide and disclose the end game.

In my opinion, that time has arrived. The long hot journey is coming to an end. I realize this is a very bold pronouncement, but it is clear that the Lord, working through none other than the corporate United States, is providing a one year opportunity for redemption. Based upon all of my experiences and knowledge, I believe we have been blessed with something that is much greater than a simple commercial strategy. Does this case/lawsuit delete all administrative judgments against the banks too, or just the recent liens you put against the prison officials last year for their tresspasses against you?

You did say "All" the liens, so I'm concluding or assuming that the court is erasing the end fruits of your work on all liens filed in California. Can't see how that is good & how that helps you in meeting your goals in helping clients or yourself? Maybe an explanation is in order why that is exciting to you, unless you are making a list of all tresspasses against you & all the trusts, but if that's true, how can you compensate on those tresspasses if the court doesn't consider what they have done to date as tresspasses against rights or property?

The Courts will just say that those administrative judgments were gotten by fraud, so they are meaningless. Also how can a Buyer or Assignee be interested in those liens if they are not considered legal or valuable by the Courts?

It is apparent that the truth doesn't matter with the courts, & winning & cheating at all costs allows them to get their way with whatever endings they want.

I had understood that Phase 2 was based on those administrative judgments. Well if that is no more, than all we have is Phase 1 & apparently the FBI put a stop to that for now. So what is the next step?

This statement I do not understand unless there was some kind of derivative or insurance policy you purchased or have for these liens getting wiped out WHERE YOU FINANCIALLY BENEFIT as if you knew that this is what the enemy would do. Maybe that's why you are so happy?

I only got to thinking about that from what the Dr. posted:

Seems kind of sick that some investors bet on a company going into the tank belly-up & financially profit from all of the companies financial woes, by being a priority claim above all others, simply because you bought a specific derivative, seems wrong to me when there's only so much money that can go around from the sale of all the companies assets. Most creditors get nothing from a companies bankruptcy.

Almost sounds like an exception to the addage, "you reap what you sow".

As the head of Enron, you could knowingly put the company into the ground by all the bad choices, & than in the last stages, bet on the companies demise, and make a financial killing & the law protects & financially blesses you!!!! How sick is that?

So the liens get discharged & that is the directional energy thrust of the enemy.

How do you use this directional force against the enemey?

In Aekido, a marshal's fighting art, the basis of this art, is that you use the force or power of the enemy against him as a weapon for yourself, SO YOU HAVE MANY WEAPONS.

For example, if the enemy draws a knife, & thrusts it towards you, you use his directional force to pull the knife in the same direction it is going, course you get out of the way of the knife. The natural reaction is that the enemy will fall down,with both forces going in the same direction if you also pull him in the same direction as he is thrusting.

If the enemy doesn't fall down he will immediately retract & pull the knife backwards quickly if he is surprised and ready by your tactic. As the enemy pulls his weight backwards, you use his own energy with all of your own PUSHING energy (synergy) to push him to the ground quickly in a backwards push & then when he's on the ground & YOU ARE ON TOP OF HIM, YOU repeatedly & quickly beat the hell out of him before he realized what happened.

Then, there's no purpose or reason in getting these liens expunged if they are worthless or have no value. It then becomes a wasted exercise by the courts. Obviously you must believe that then.

First of all, the idea of selling liens overseas was not advertised to get clients or string them along in some sort of deception to keep them believing in some sort of financial restitution or redemption. Clients paid money & joined to get their mortgages discharged of record, because they believed the banks would accept those discharges after the lenders bad faith was shown by their inability to refute the presentment, not because they believed that there was monetary value in administrative liens through the dorean process. The idea of selling those liens came much later in the history of the dorean saga as a revelation to most clients. It only became a bonus to think that at a later date, we might get more than a discharge of mortgage.

Liens are bought & sold all the time. If liens are valid, they don't have to be sold overseas. There's plenty of domestic buyers for such commodities.

Judge: If one believes that the lenders commit mail fraud, bank & wire fraud in the very process of extending a loan, than the idea of administrative judgments perfected against the lender is not necessary to believe in, in order to string a client along & give him hope.

The tobacco companies got away with their fraud for many decades, & went unpunished, but eventually people believed that smoking & cancer have a link. Eventually the companies were forced to put disclaimer warnings on their cigarette packages & admit that there are some health risks even though they denied their fraud for decades & got away with it.

If the Court, the prosecution the FBI, or the many players that have attempted to prove that the Dorean Group is a scam & punish the clients & Principals at all costs by their lying or by their own deceptive works, than the Dorean Group is entitled to financial compensation if such can be proven or shown that all these players acted in bad faith through malicious & deceitful acts.

You can't change history or expunge all the records. There should be enough weapons to use in the historical aspect of testimony & tresspasses already when you consider personal & property right violations that have been trampled upon by the many actors.

Look at all the Japanese people during World War II that were put in concentration camps here in the US even though they were Americans. The government didn't recognize those consitutional tresspasses until many decades later.

Even the Mormons in the 1800's were thrown out of their homes & there was an "exterminating order" by Governor Boggs in Illinois. So you could throw them out of their home & kill them, & that's OK, because the governor of Illinois believed that the Mormons didn't deserve to live in that State & were considered a "nuisance". Ridding a nuisance of course is no crime, right?

An apology & an acknowledgment of the government's bad faith wasn't given until the
20th century, but it did come, none the less.

Maybe it might take some considerable time to get justice, but justice is sure, as is the word of the Lord. That's what you don't understand! You live in the now & your understanding doesn't include the future.

Federal agents raid Las Vegas locations

Federal agents swarmed into a local business and home early Thursday morning.

Several men are facing charges ranging from owning machine guns to evading taxes.

One of the raids forced a school into lockdown.

One of the suspects appeared in court shortly after his arrest, and that’s when things got even more interesting.

Armored personnel carriers, federal agents wearing tactical gear, blanketing a Northwest Las Vegas neighborhood early Thursday morning.

It’s little wonder J Suson tried rubbng the sleep from his eyes a second time.

“I thought I was dreaming,” he says.

But J wasn’t, so he grabbed his camera, and an earful.

“Basically, [they were saying] we’ve got a search warrant, we need you to come out, a whole bunch of undercover FBI people everywhere,” he says.

Agents arrested four people, Jan Allen Lindsey, a possible former special investigator for the same bureau, but openly outspoken against the government’s collection of taxes.

“In the internal revenue code 26, there’s nothing specific in there,” he said in a documentary about taxes.

The IRS begs to differ.

Action news has obtained the indictment against Lindsey.

It alleges that from 1999 through 2006, he either didn’t pay his income tax, or filed false forms.

The indictment also alleges Lindsey essentially tried to dupe the government by placing assets in third party names.

Agents raided a business as well.

All of their weaponry and armor was because at least one of the other suspects faces a federal firearms charge.

Agents also confiscated ammunition and reloading equipment from the home. The other two suspects face money laundering charges.

Lindsey was set to be arraigned Thursday, but would not allow a public defender to represent him.

He also said he refused to observe the judge’s authority.

The arraignment had to be continued.

According to other documents obtained by Action News, Lindsey tried to sue the government in 2002 for seizing his property because he didn’t pay taxes.

A judge threw it out, and ordered him to pay more than $1200 for a quote- “frivilous complaint.”



More details revealed about those arrested in FBI raids Thursday

Some of the four men arrested during a series of raids Thursday by federal agents appeared in court Friday.

The FBI raided a Las Vegas business Thursday because after hours it was the meeting place of the People’s Sovereign Court, a libertarian social organization with what some might call extreme anti-government views.

Its leader is Sam Davis whose name is on one of the Grand Jury indictments.

He’s accused of laundering more than $500,000 that undercover agents said had been stolen from Wachovia.

Jan Lindsey is a former FBI agent himself who is featured in a documentary titled, “Freedom to Fascism”.

It chronicles the legal battles of people who refused to pay their taxes.

Lindsey was in court Thursday, refusing to acknowledge the judge’s jurisdiction.

“I want to make sure that you understand what the government says you did wrong. Whether your agree with it or not is for future litigation. You understand that sir,” asked the judge.

“What the government says I did wrong,” asked Lindsey.

“Yes, sir,” replied the judge.

Two other men were arrested in the FBI raids.

Shawn Rice, accused in the indictment of laundering money also, by claiming to be a Rabbi, and taking the deposits as charitable contributions.

Harold Call was arrested on five counts of possessing machine guns and converting single-fire weapons illegally to automatic weapons.

SAN FRANCISCO (MarketWatch) — Counterparty credit risk in the derivatives market surged to a new record Monday, reflecting concern that the U.S. financial system remains fragile in the midst of a long recession.
The CDR Counterparty Risk Index, which tracks credit default swaps on leading banks and brokerage firms, jumped more than 13 basis points to a record 300.9 during midday action.The index, compiled by New York-based Credit Derivatives Research, has risen more than 53 basis points since last week. A basis point is one-hundredth of a percentage point.

Credit default swaps are a common type of derivative contract that, as the name implies, pay out in the event of default. When prices for credit default swaps rise, that suggests investors are willing to pay more to protect against defaults.

Many bankers are being arrested as the battle to take down the banksters reaches its final phase

Reports from reliable sources are saying that senior bankers are being arrested in droves. Some sources also say the bankers are trying to blackmail their way into being protected by threatening to spread a very toxic form of bird flu. They just cannot imagine giving up their dollar printing machine. However, both President Obama and UK Prime Minister Brown have now publicly promised to take on the banksters. The situation is coming to a head.

Once the banksters surrender we can expect very dramatic changes for the better in the world situation.

Editor’s note: The following article is an example of how far we have drifted from our constitutional principles in this country. The author of this article seems to think reclaiming the country in the name of the Constitution and the Bill of Rights is a “right wing” concept. If we follow this logic, then, the left wing wants tyranny, dictatorship, and a police state. In fact, it seems Chuck Norris is moving away from the Republican party — in his article on WND, linked below, he actually claims there is little difference between the two parties — and is calling for a Second American Revolution. If this is “right wing,” count me in.

The call by some right wing leaders for rebellion and for the military to refuse the commander in chief’s orders is joined by Chuck Norris who claims that thousands of right wing cell groups have organized and are ready for a second American Revolution. During an appearance on the Glen Beck radio show he promised that if things get any worse from his point of view he may “run for president of Texas.” The martial artist/actor/activist claims that Texas was never formally a part of the United States in the first place and that if rebellion is to come through secession Texas would lead the way.

Today in his syndicated column on WorldNetDaily Norris reiterates the point: “That need may be a reality sooner than we think. If not me, someone someday may again be running for president of the Lone Star state, if the state of the union continues to turn into the enemy of the state.”

He continues; calling on a second American Revolution; “…we’ve bastardized the First Amendment, reinterpreted America’s religious history and secularized our society until we ooze skepticism and circumvent religion on every level of public and private life.

How much more will Americans take? When will enough be enough? And, when that time comes, will our leaders finally listen or will history need to record a second American Revolution? We the people have the authority according to America’s Declaration of Independence, which states: That whenever any Form of Government becomes destructive of these ends, it is the Right of the People to alter or to abolish it, and to institute new Government…”

Norris claims that; “Thousands of cell groups will be united around the country in solidarity over the concerns for our nation.” The right wing cells will meet during a live telecast, "We Surround Them," on Friday March 13 at 5 p.m.

He closes with the words of Sam Houston followed by a plug for his next martial arts event.

The SEC alleges that Friedman, along with his two companies, Diversified Lending Group (DLG) and Applied Equities, Inc. (AEI), perpetrated a $216 million real estate investment fraud scheme, raising money from investors nationwide, many of whom are seniors, promising guaranteed high returns via real estate investments. Another PONZI FRAUD bites the dust.

The SEC complaint alleges that Friedman diverted substantial investor money to ventures that were unrelated to real estate, and misappropriated at least $17 million to support his hyperlavish lifestyle, including purchases of a luxury home, cars, vacations, jewellery, and designer clothing for himself and a female of his acquaintance. The SEC has frozen DLG’s, AEI’s and Friedman’s assets.
