The Work of Patience (10-29-09)
The scriptures say tribulation worketh patience. At first glance this does not seem like an adorable promise. Yet I have a continual if not lingering proof in my trial that these words are true. There is something in the human psyche that gravitates towards comfort, resolution, and peace. No matter how obvious the hand of the Lord is revealed working to my good in trial I crave its end. Whether another 90 days or longer the delays rub me the wrong way. But patience is an excellent companion to bring alongside your faith. For faith which has inherent within it a trust muscle needs the endurance supplied by the aid of patience. As creatures of limited sense it is very easy for us to misinterpret God's ways and nature. We pray with eyes closed and expect our prize displayed before our eyes as soon as they open. Mostly this infancy is rare yet we'll doubt God and shipwreck our faith in an instant. God is very kind to move us beyond this self-centered toddler mentality. Through His patient work and situations that anchor us to a hope in Him we are dragged by patience to the faith obtained promise which ultimately exposes our doubts a fraud. It is a sharp edge that cuts to the very morrow of our being. It is where wheat and tores, sheep and goats, we divided. But all harvest is obtained by patience. Fight it or fight yourself because tribulation worketh patience.

Investors and the homeowners have a lot of interests in common. When they finally get together and compare notes, they find a giant donut hole where assets or money were supposed to be. The amount of theft or undisclosed fees and profits staggers the imagination. It would take 200 like Bernie Madoff to even get close. Watch these lawsuits and the news reports. As the investors start firing the servicers (who probably don’t have any authority now anyway) and start hiring new servicers they will be performing due diligence. As they trace the paperwork and discover the incurable gaps in title, ownership, credit and money trails, you will find them changing the narrative considerably from blame the borrower to how can we work with borrowers to minimize our losses?
And wait until they figure out that millions of foreclosed homes are NOT being held for the investors in inventory and hundreds of thousands of homes “sold” have toxic titles where the proceeds of sale were not given to the investors either.

Much attention has been given over the last several months to the fact that oftentimes, the Plaintiffs filing foreclosure lawsuits are not able to produce the basic documents they need to file a foreclosure lawsuit, much less all the documents they need to produce in order to win a foreclosure case. Examples of documents that need to be produced include the note, assignment of mortgage and an accurate statement of account. Because many lenders cannot even prove they are qualified or entitled to appear in court, they never get the point of producing the documents necessary to effectively proceed with their foreclosure case. It is clear to me from the Florida Supreme Court Final Order that the courts know what a disaster all this is and they’re struggling not to issue orders that force the whole system to collapse. Ordering everyone to mediation is a punt and a way to say to the lenders,the defense guys have you on the procedure and the “legal” stuff so go work it out. Note that in the mediation order Plaintiffs are required to prove up a chain of title if requested by the Defendant, that’s a big hidden silver bullet.
